RE: The tariff classification of timer trippers from China

Dear Ms. Chowning:

In your letter dated November 4, 2009, you requested a tariff classification ruling.

The merchandise is a package of replacement timer trippers made of steel. The trippers are used on a mechanical timer dial to turn the timer on and off. Included in the package are two silver-toned trippers that turn a timer on, two gold-toned trippers that turn a timer off, and four screws that attach the trippers to the dial.

In your letter, you proposed classification for the timer replacement trippers under subheading 9114.40.8000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other clock or watch parts, other, other.  However, the National Import Specialist who handles watches, clocks, timers and time switches does not agree with your proposed classification because heading 9114, HTSUS, does not cover parts of timers or time switches.  There is no provision for parts of timers or time switches in chapter 91, HTSUS. Therefore, the timer trippers are classified under heading 7326, HTSUS, which provides for other articles of iron or steel.

The applicable subheading for the timer trippers will be 7326.90.8588, HTSUS, which provides for other articles of iron or steel, other, other, other, other, other. The rate of duty will be 2.9 percent ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Ann Taub at (646) 733-3018.

Sincerely,
